VEHICLE AND TRAFFIC (VEHICLE OPERATIONS) REGULATIONS 2001 (S.R. 2001, NO. 168) - REG 63

Speed limiting devices
(1)  In this regulation,
prescribed vehicle means –
(a) a bus with a GVM greater than 5 tonnes; or
(b) another motor vehicle with a GVM greater than 12 tonnes.
(2)  The Registrar, by notice in writing, may direct the registered operator of a prescribed vehicle to fit a speed limiting device to that vehicle within such time as is specified in the notice.
(3)  The Registrar must not exercise his or her power under subregulation (2) unless satisfied, as a result of vehicle testing or obtaining other reliable evidence, that the vehicle intended to be fitted with a speed limiting device is capable of being driven on a level road at a speed exceeding 100 kilometres per hour.
(4)  A person must comply with a direction under subregulation (2) .
Penalty:  In the case of –
(a) a first offence – 20 penalty units; and
(b) a second or subsequent offence – 40 penalty units.
(5)  A person must not, without lawful excuse –
(a) remove a speed limiting device from a prescribed vehicle; or
(b) alter, adjust or otherwise tamper with a speed limiting device fitted to a prescribed vehicle; or
(c) otherwise render a speed limiting device ineffective.
Penalty:  In the case of –
(a) a first offence – 20 penalty units; and
(b) a second or subsequent offence – 40 penalty units.
