(1) A person prescribed for the purposes of section 118C may issue an information notice to a financial institution for the purposes of satisfying a pecuniary penalty order or an order under section 12 of the Crimes (Confiscation of Profits) Act 1986 before its repeal.

(2) A person prescribed for the purposes of section 118C must not issue an information notice under subsection (1) unless he or she reasonably believes that—

(a) a pecuniary penalty order has
been made against an accused in relation to a Schedule 1 offence or a
Schedule 2 offence; and
(b) the issuing of the information notice is required to satisfy the pecuniary penalty order.

(3) A person prescribed for the purposes of section 118C may issue an information notice to a financial institution for the purposes of—

(a) managing specified property in respect of which a restraining order or a civil forfeiture restraining order or an unexplained wealth restraining order has been made; or
(b) managing or disposing of specified property that has been forfeited under this Act.

(4) A person prescribed for the purposes of section 118C must not issue an information notice under subsection (3) unless he or she reasonably believes that the issuing of the information notice is required to manage or dispose of the specified property.
