LONG SERVICE BENEFITS PORTABILITY ACT 2018 - SECT 51

Disclosure of information to other entities and authorities

    (1)     The Authority may disclose information in relation to an employer's compliance with this Act—

        (a)     to a Victorian government entity for the purpose of the performance of a function of the entity under a law of Victoria; or

        (b)     to a Commonwealth government entity for the purpose of the performance of a function of the entity under a law of the Commonwealth.

    (1A)     The Authority may disclose relevant information to a prescribed non-government entity for the performance of a function of that entity.

    (1B)     At the request of the trustee, the Authority may disclose relevant information to the trustee for the performance of the trustee's functions.

    (2)     The Authority may disclose information in relation to a registered active worker's credit for service and long service benefits to a reciprocal authority for the purpose of the performance of—

        (a)     a function of the Authority under this Act; or

        (b)     a function of the reciprocal authority under a corresponding law.

    (3)     In this section—

"Commonwealth government entity" means—

        (a)     the office of the Fair Work Ombudsman; or

        (b)     a prescribed entity;

"trustee" has the same meaning as in the Construction Industry Long Service Leave Act 1997 ;

S. 51(3) def. of Victorian government entity amended by No. 14/2021 s. 39.

"Victorian government entity" means—

        (a)     the Victorian WorkCover Authority; or

        (b)     Victoria Police; or

        (ba)     the Wage Inspectorate Victoria; or

        (c)     a prescribed entity.
