PRIVACY AND DATA PROTECTION ACT 2014 - SECT 65

Minister may refer a complaint direct to VCAT

S. 65(1) amended by Nos 20/2017 s. 106(5), 31/2024 s. 54.

    (1)     If the Minister considers that the subject matter of a complaint raises an issue of important public policy, the Minister may refer the complaint directly to VCAT for hearing under Subdivision 5, whether or not the Information Commissioner has considered it or the complaint is in the process of informal resolution or is being conciliated.

    (2)     The Minister is not a party to a proceeding on a complaint referred to VCAT under subsection (1) unless joined by VCAT.
