PRIVACY AND DATA PROTECTION ACT 2014 - SECT 73

When may VCAT hear a complaint?

    (1)     VCAT may hear any of the following—

S. 73(1)(a) amended by No. 20/2017 s. 106(5).

        (a)     a complaint referred to it by the Information Commissioner under section 62, 66 or 71;

        (b)     a complaint referred to it by the Minister under section 65.

    (2)     VCAT also has the jurisdiction conferred by section 72.

S. 73(3) amended by No. 20/2017 s. 85.

    (3)     If a certificate has been given in respect of a document under section 83J(2) , the powers of VCAT—

        (a)     do not extend to reviewing the decision to give the certificate; and

        (b)     are limited to determining whether a document has been properly classified as an exempt document of a kind referred
to in section 28(1) of the Freedom of Information Act 1982 .
