ROAD MANAGEMENT ACT 2004 - SECT 119A

Removal of stationary vehicles

S. 119A(1) amended by Nos 70/2016 s. 5(1), 49/2019 s. 183(Sch.  3 item 32(a)).

    (1)     The Head, Transport for Victoria may move or cause to be moved from a freeway or any other road in respect of which the Head, Transport for Victoria is the coordinating road authority any vehicle

        (a)     that is parked or left standing on that road contrary to any law; or

        (b)     that in the opinion of the Head, Transport for Victoria—

              (i)     is, or is likely to be or to cause, a danger to other road users; or

              (ii)     is causing, or is likely to cause, traffic congestion; or

        (c)     that is disabled or damaged.

Note

Under section 19, the Head, Transport for Victoria must keep a register of public roads that specifies the public roads in respect of which it is the coordinating road authority.

    (2)     A person acting in accordance with subsection (1)—

        (a)     may enter a vehicle using, if necessary, reasonable force, for the purpose of conveniently or expeditiously moving it; and

        (b)     may move the vehicle to the nearest convenient place; and

        (c)     may store the vehicle.

    (4)     The Head, Transport for Victoria may recover from the owner of a vehicle moved or stored under this section any reasonable costs incurred in moving or storing it.

    (5)     In this section "vehicle" includes anything attached to, within, or on, the vehicle.
