RESIDENTIAL TENANCIES ACT 1997 - SECT 498U

An SDA provider or their agent has a right to enter an SDA dwelling together with any persons who are necessary to achieve the purpose of the entry—

        (a)     at any time agreed with the SDA resident if—

S. 498U(a)(i) amended by No. 9/2023 s. 177(2).

              (i)     in the case of an SDA dwelling occupied by one SDA resident, the SDA resident has consented to the entry not more than 7 days before the entry; or

S. 498U(a)(ii) amended by No. 9/2023 s. 177(2).

              (ii)     in the case of an SDA dwelling occupied by more than one SDA resident, all the SDA residents have consented to the entry not more than 7 days before the entry; or

S. 498U(b) substituted by No. 19/2019 s. 169.

        (b)     at any time between 8 a.m. and 6 p.m. on any day (except a public holiday)—

              (i)     for a purpose set out in section 498V(1)(a) or (b), if at least 48 hours notice has been given to the SDA resident or SDA residents in accordance with section 498X; or

              (ii)     for a purpose set out in section 498V(1)(c) or (f), if at least 24 hours notice has been given to the SDA resident or SDA residents in accordance with section 498X; or

              (iii)     for a purpose set out in section 498V(1)(d) or (e), if at least 7 days notice has been given to the SDA resident or SDA residents in accordance with section 498X.
