ROAD SAFETY (DRIVERS) REGULATIONS 2019 - REG 73

Secretary to record demerit points

Reg. 73(1) amended by S.R. No. 172/2019 reg. 5(Sch. 2 item 54).

    (1)     For the purposes of section 35(3) of the Act, the Secretary must record in the Demerits Register the appropriate number of demerit points against a person if the Secretary is duly notified that—

        (a)     the person has been convicted, or found guilty, of a relevant offence; or

        (b)     the penalty specified in an infringement notice issued to the person in relation to a relevant offence has been paid in accordance with the Infringements Act 2006 or Fines Reform Act 2014 ; or

        (ba)     the person has, in relation to a relevant offence, made the relevant first infringement payment; or

Reg. 73(1)(bb) inserted by S.R. No. 9/2023 reg. 4(2).

        (bb)     an infringement notice issued to the person in relation to a relevant offence has been withdrawn by an enforcement agency under section 25(2)(b) or (c) of the Infringements Act 2006 ; or

        (c)     the person has had a conviction imposed by a court under section 89(4) of the Act in relation to a relevant offence; or

        (d)     an infringement notice issued to the person in relation to a relevant offence has taken effect as a conviction under section 89A(2) of the Act; or

        (e)     an enforcement order that is in force has been made against the person under Schedule 3 to the Children, Youth and Families Act 2005 in relation to a relevant offence; or

        (f)     a proceeding against the person for a relevant offence has been adjourned under section 59(2) of the Criminal Procedure Act 2009 or section 356D(1) of the Children, Youth and Families Act 2005 .

    (2)     For the purposes of section 35(3) of the Act, the Secretary must also record in the Demerits Register the appropriate number of demerit points against a person if—

        (a)     the Secretary is duly notified that a notice of final demand has been served on the person under  section 23 of the Fines Reform Act 2014 in relation to a relevant offence; and

        (b)     the Secretary has not been notified that notice of an enforcement cancellation has been served on the enforcement agency under section 37(2) of that Act in relation to the infringement fine for the relevant offence.

    (3)     Despite anything to the contrary in this regulation, the Secretary must not record demerit points against a person in the Demerits Register if more than 12 months have elapsed since the Secretary was duly notified of a relevant event.

    (4)     In this regulation—

"relevant first infringement payment" means the first payment made in accordance with a payment plan under Part 3 of the Infringements Act 2006 or a payment arrangement under Part 5 of the Fines Reform Act 2014 that is—

        (a)     subsequently reversed; or

        (b)     the subject of a chargeback; or

        (c)     dishonoured.
