TRANSPORT (COMPLIANCE AND MISCELLANEOUS) (TICKETING) REGULATIONS 2017 - REG 7

Obligation to hold valid ticket

    (1)     A person who is travelling in a passenger vehicle must have in the person's possession a ticket that is valid for the whole of the person's travel in that passenger vehicle.

Penalty:     10 penalty units.

Note

Regulation 13 sets out the defence that may apply in respect of a charge under this subregulation.

    (2)     A person who is in a compulsory ticket area must have in the person's possession a ticket that is valid for that entry to the compulsory ticket area.

Penalty:     10 penalty units.

Regulation 14 sets out the defence that may apply in respect of a charge under this subregulation.

    (3)     For the purposes of this regulation, a person has a ticket in the person's possession only if—

        (a)     the person holds—

              (i)     in the case of a ticket that is a digital card, the personal electronic device on which the digital card is stored on or about their person; or

              (ii)     in the case of a ticket that is a V/Line digital ticket, a personal electronic device on which the V/Line digital ticket can be displayed on or about their person; or

              (iii)     in any other case, the ticket on or about their person; or

        (b)     the person is accompanied by another person and that other person holds—

              (i)     in the case of a ticket that is a digital card, the personal electronic device on which the digital card is stored on or about their person on behalf of the first‑mentioned person; or

              (ii)     in the case of a ticket that is a V/Line digital ticket, a personal electronic device on which the V/Line digital ticket can be displayed on or about their person on behalf of the first-mentioned person; or

              (iii)     in any other case, the ticket on or about their person on behalf of the first-mentioned person.

Examples

For the purposes of subregulation (3)(b), examples of another person holding a ticket on a person's behalf are—

              •     a parent, foster carer or person who is granted guardianship of a child holding a ticket on behalf of a child; and

              •     the holder of a ticket authorising group travel.
