TRANSPORT (COMPLIANCE AND MISCELLANEOUS) (TICKETING) REGULATIONS 2017 - REG 7

Obligation to hold valid ticket

    (1)     A person who is travelling in a passenger vehicle must have in the person's possession a ticket that is valid for the whole of the person's travel in that passenger vehicle.

Penalty:     10 penalty units.

Note

Regulation 13 sets out the defence that may apply in respect of a charge under this subregulation.

    (2)     A person who is in a compulsory ticket area must have in the person's possession a ticket that is valid for that entry to the compulsory ticket area.

Penalty:     10 penalty units.

Note

Regulation 14 sets out the defence that may apply in respect of a charge under this subregulation.

    (3)     For the purposes of this regulation, a person has a ticket in the person's possession only if—

        (a)     the person holds the ticket or, in the case of a ticket that is a digital card, the personal electronic device on which the digital card is stored on or about their person; or

        (b)     the person is accompanied by another person and that other person holds the ticket or personal electronic device on or about their person on behalf of the first‑mentioned person.

Examples

For the purposes of subregulation (3)(b), examples of another person holding a ticket on a person's behalf are—

              •     a parent, foster carer or person who is granted guardianship of a child holding a ticket on behalf of a child; and

              •     the holder of a ticket authorising group travel.
