(1) The Minister may from time to time declare that the Freeway Corporation is to be the responsible road authority for a road or part of a road on licensed land.
(2) The Minister must cause a notice of a declaration under sub-section (1) to be published in the Government Gazette.
(3) On the publication of a notice of a declaration under sub-section (1), the Freeway Corporation is deemed to be the responsible road authority under the Road Management Act 2004 for the road or part of a road specified in the declaration.
(4) The Road Management Act 2004 (except Division 4 of Part 4 and Schedule 7) applies to a road or part of a road specified in a declaration under sub-section (1) as if any reference in that Act to the Mitcham-Frankston Freeway were a reference to the road or part of a road specified in the declaration.
(5) The Minister may at any time revoke a declaration under sub-section (1).
(6) The Minister must cause a notice of a revocation of a declaration under sub-section (1) to be published in the Government Gazette.
(7) On the publication of the notice of revocation of a declaration under this section, the Freeway Corporation ceases to be the responsible road authority for the road or part of a road specified in the declaration.
Division 3—Road Declaration Powers
