MARINE SAFETY ACT 2010 (NO. 65 OF 2010) - SECT 65

Issue of safe construction certificate by the Safety Director

    (1)     Subject to subsection (2), the Safety Director may issue a safe construction certificate to the owner of a commercially operated vessel or to the owner of a fleet of commercially operated vessels who has made an application under section 64.

    (2)     The Safety Director must not issue a safe construction certificate to an applicant under subsection (1) unless the Safety Director is satisfied that the vessel or the fleet of vessels the subject of the application—

        (a)     meets the prescribed standards for that class or type of vessel or vessels; and

        (b)     meets any other prescribed requirements for that class or type of vessel or vessels.

    (3)     A safe construction certificate is subject to any conditions imposed by the Safety Director or prescribed by the regulations.

    (4)     A safe construction certificate may be issued for a period not exceeding 5 years.

    (5)     The Safety Director may at any time require a vessel in respect of which a safe construction certificate has already been issued, and that is in effect, to be surveyed.

    (6)     The Safety Director does not warrant that a vessel is safe by the issue of a safe construction certificate issued in respect of that vessel under this section.
