MARINE SAFETY ACT 2010 (NO. 65 OF 2010) - SECT 99

Authority of Governor in Council to make regulations in relation to powers under Conventions

    (1)     This section applies if—

        (a)     under this Division, the Governor in Council is empowered to make regulations for and in relation to giving effect to any of the provisions of the Safety Convention or the Prevention of Collisions Convention; and

        (b)     the Safety Convention or the Prevention of Collisions Convention vests in the several Governments who are parties to those Conventions a power to exercise a discretion as to whether any, and if so what, action should be taken in respect of a provision of those Conventions (a Convention power ).

    (2)     The power to make regulations is to be construed as an authority conferred on the Governor in Council to make regulations for or with respect to a Convention power.
