SERIOUS OFFENDERS ACT 2018 (NO. 27 OF 2018) - SECT 81

Period of interim detention order

    (1)     Subject to subsection (2), the period of an interim detention order is a period not exceeding 4 months specified by the Supreme Court in the order.

    (2)     The maximum period of an interim detention order, including any extensions, must not exceed 4 months unless the Supreme Court making or extending the interim detention order is satisfied that exceptional circumstances exist.

    (3)     Any time spent in custody on remand or serving a custodial sentence during the period of an interim detention order that has commenced counts in calculating the period of the interim detention order.

    (4)     Any time spent in immigration detention during the period of an interim detention order that has commenced does not count in calculating the period of the interim detention order.
