(1) A person to whom this regulation applies must store any Schedule 4 poisons in the person's possession in a lockable storage facility.
Penalty: 100 penalty units.
(2) A person to whom this regulation applies must take all reasonable steps to ensure that the storage facility referred to in sub-regulation (1) remains locked and secured to prevent access by an unauthorised person at all times, except—
(a) when it is necessary to open it to carry out an essential operation in connection with the poisons stored in it; or
(b) in the case of poisons stored in accordance with sub-regulation (3)(a) or (b), when a registered medical practitioner, pharmacist, veterinary practitioner, dentist, nurse practitioner, authorised optometrist or nurse authorised under regulation 5(2)(a) is present.
Penalty: 100 penalty units.
(3) Despite sub-regulations (1) and (2), a registered medical practitioner, pharmacist, veterinary practitioner, dentist, nurse practitioner or authorised optometrist may store Schedule 4 poisons at the premises in which he or she carries out the lawful practice of his or her profession in—
(a) the dispensing area or pharmacy department of the premises; or
(b) the treatment room of the premises; or
(c) in an area separated from the remainder of the premises and to which only a registered medical practitioner, pharmacist, veterinary practitioner, dentist, nurse practitioner or authorised optometrist has access.
(4) This regulation applies to—
(a) a registered medical practitioner, pharmacist, veterinary practitioner, dentist, nurse practitioner and authorised optometrist; and
(b) a person holding a licence, permit or warrant to manufacture, sell, supply, purchase or otherwise obtain, possess, administer or use a Schedule 4 poison; and
(c) a nurse approved under regulation 5(3) to be in possession of a Schedule 4 poison.
