Protection against breach of trust77A. Protection against breach of trust (1) A cause of action does not lie in respect of any breach of trust or fiduciary duty by reason of any failure to pay to, or credit to the account of, a resident in a relevant institution any money earned on the investment of money held in trust by that relevant institution for that resident. (2) This section only applies to breaches that occurred before the commencement of section 4 of the Intellectually Disabled Persons' Services (Trust Money) Act 1992. (3) In sub-section (1), "relevant institution" means- (a) any training centre proclaimed under section 24(1)(c) of the Mental Health Act 1959; and (b) the following institutions operated by the Department on 24 November 1987- (i) St. Gabriel's; (ii) Pleasant Creek; (iii) Sandhurst; (iv) Colanda.
