(1) A person who
enters or remains on any land to which this Part applies, or is shown to have
been within the boundaries of that land, shall be guilty of an offence, unless
he establishes to the satisfaction of the court that he is —
(a) a
person of Aboriginal descent; or
(b) a
member of either House of the Parliament of the State or of the Commonwealth;
or
(c) a
person lawfully exercising a function under this Act or otherwise acting in
pursuance of a duty imposed by law; or
(d) a
person authorised in that behalf under the regulations.
(2) A prosecution for
an offence under subsection (1) must not be commenced without the authority of
the CEO.
