(1) A person who, in
purported compliance with a provision of the relevant corresponding
co-operatives law that corresponds to section 68 —
(a)
gives a person intending or applying to become a member of a participating
co-operative a document as a copy of —
(i)
a special resolution of the co-operative; or
(ii)
the most recent financial information reported to members
of the co-operative under Part 10A;
and
(b)
knows or ought to know that, in a material respect, it is not a true copy of
the resolution or information; and
(c) does
not indicate to that person that it is not a true copy,
is guilty of an
offence.
Penalty for this subsection: a fine of $1 000.
(2) A person who, in
purported compliance with a provision of the relevant corresponding
co-operatives law that corresponds to section 68 —
(a)
makes available for inspection by a person intending or applying to become a
member of a participating co-operative a document as a copy of —
(i)
a special resolution of the co-operative; or
(ii)
the most recent financial information reported to members
of the co-operative under Part 10A;
and
(b)
knows or ought to know that, in a material respect, it is not a true copy of
the resolution or information; and
(c) does
not indicate to that person that it is not a true copy,
is guilty of an
offence.
Penalty for this subsection: a fine of $1 000.
