(1) If a fortification
warning notice has been given as described in section 70(1) and the submission
period has elapsed, the Commissioner of Police may issue a fortification
removal notice relating to the premises concerned.
(2) The Commissioner
of Police cannot issue the fortification removal notice unless, after
considering each submission, if any, made before the submission period
elapsed, the Commissioner of Police reasonably believes that the premises are
—
(a)
heavily fortified; and
(b)
habitually used as a place of resort by members of a class of people a
significant number of whom may reasonably be suspected to be involved in
organised crime.
(3) A fortification
removal notice cannot be issued if —
(a) a
period of more than 28 days has elapsed since the end of the submission
period; or
(b) the
Commissioner of Police has given any person a withdrawal notice referring to
the fortification warning notice concerned.
