(1) Subject to
section 40G, nothing in this Act shall prejudice, abridge or take away any
right of action that any person may have in respect of any act or omission of
another unless that act or omission occurs in pursuance of any authority
lawfully given under this Act.
(2) The recovery of
any penalty under this Act does not affect any such right of action as is
referred to in subsection (1).
