(1) This section
applies to a relevant entity if —
(a) the
entity is not a department or an organisation, as those terms are defined in
the Public Sector Management Act 1994 section 3(1), or an authority; and
(b)
there is no chief executive officer of the entity (however described) or
principal officer of the entity (however described); and
(c) the
regulations do not prescribe a person to be the head of the entity.
(2) The relevant
entity must nominate a person or the holder of a position in the entity to be
the head of the entity.
(3) The nomination
must be in writing and given to the Commissioner.
(4) The Commissioner
may, by written notice given to the relevant entity, approve the person or
holder of the position in the entity nominated by the entity under subsection
(2) to be the head of the entity.
(5) The Commissioner
may, by written notice given to the entity, revoke an approval under
subsection (4).
