(1) A person must take
all reasonable and practicable steps to prevent or minimise any harm to public
health that might foreseeably result from anything done or omitted to be done
by the person.
(2) In determining
what is reasonable and practicable for the purposes of subsection (1), regard
must be had, amongst other things, to the objects of this Act, and to the
following —
(a) the
potential impact of a failure to comply with the duty;
(b) any
environmental, social, economic or practical implications;
(c) any
degrees of risk that may be involved;
(d) the
nature, extent and duration of any harm;
(e) any
matter prescribed by the regulations.
(3) A person will be
taken not to be in breach of subsection (1) if the person is acting —
(a) in a
manner or in circumstances that accord with generally accepted practices
taking into account community expectations and prevailing environmental,
social and economic practices and standards; or
(b) in
circumstances prescribed by the regulations.
