(1) This section
applies to a person who constitutes, or is to constitute, the Tribunal for the
purposes of a particular matter, whether with or without others, and who has
or acquires an interest, pecuniary or otherwise, that could conflict with the
proper performance of the person’s functions as a member in relation to
that matter.
(2) The person is to
disclose the nature of the person’s interest to the President or, if the
person is the President, to the Chief Justice of Western Australia.
(3) The person is not
allowed to be a sitting member of the Tribunal, or perform any function as a
Tribunal member, in relation to the matter unless each of the parties involved
agrees.
