(1) Judges in the
General Division have seniority according to the following order —
(a) the
Chief Justice;
(b) the
other judges, excluding the judges of appeal, according to the dates of their
commissions of appointment as judges.
(2) Judges of appeal
have seniority according to the following order —
(a) the
Chief Justice;
(b) the
President;
(c) the
other judges of appeal according to the dates of their commissions of
appointment as judges of appeal.
(3) Masters have
seniority according to the dates of their commissions of appointment as
masters.
(4) If 2 or more
persons receive commissions dated the same day, their seniority as between
them is to be determined —
(a)
according to the dates on which they begin in office; or
(b) if
they are to begin in office on the same day, by the Governor when appointing
them.
(5) For the purposes
of any other written law or any matter connected with the administration of
the State, the seniority of judges is to be determined under subsections (1)
and (4).
