(1) A person shall not
publish, or cause to be published, an advertisement in relation to any animal
feeding stuff that is false, misleading or deceptive or that cannot be
substantiated in any particular.
(2) No prosecution
shall be instituted against a person, not being the author of the
advertisement, who prints or publishes an advertisement in breach of the
provisions of subsection (1) unless —
(a) a
warning has been delivered to that person under the hand of the Director
within the 3 months immediately preceding the day of the publication, that in
the opinion of the Director the advertisement, or some other advertisement
substantially to the same effect, is not in the public interest; or
(b) that
person can be shown to have an interest in the promotion of the sale of the
product advertised otherwise than in the normal course of the business of a
printer or a publisher.
