(1) Subject to this
Act, the Commission may appoint such officers or employees as it thinks
necessary for the purposes of this Act.
(2) On the date of the
coming into operation of this Act, all officers and employees who were
employed immediately preceding that date in the State Shipping Service, and
who are willing and able to be employed by the Commission, shall be deemed to
be appointed officers and employees of the Commission under this Act on the
same terms and conditions as they were employed by the State Shipping Service
immediately preceding that date.
(3) Where an officer
or employee appointed or deemed to be appointed in pursuance of this section
was, immediately before such appointment, an officer or employee in the State
Shipping Service —
(a) he
retains his existing and accruing rights and in particular his rights, if any,
under the Superannuation and Family Benefits Act 1938 1 ; and
(b) for
the purpose of determining those rights, his service as an officer or employee
of the State Shipping Service shall be taken into account as if it were
service with the Commission.
