A person, other than
the holder of a commercial fishing licence, must not —
(a) set
a fishing net in any ocean waters outside 800 m of the low water mark of any
part of the State or any island within WA waters; or
(b) use
a metal stake in connection with the setting of a fishing net; or
(c)
leave a stake which was used in connection with the setting of a fishing net
after the net is retrieved; or
(d) in
the waters lying south of a line drawn from Cape Inscription on Dirk Hartog
Island due east to the mainland —
(i)
use any stake in connection with the setting of a fishing
net; or
(ii)
set or leave a set fishing net within the period
beginning 1½ hours after sunrise and ending 1½ hours before
sunset on any one day.
Penalty: $2 000.
