The Relevant Regulator
may approve proposed revisions to an Access Arrangement only if it is
satisfied the Access Arrangement as revised would contain the elements and
satisfy the principles set out in sections 3.1 to 3.20. The Relevant Regulator
must not refuse to approve proposed revisions to the Access Arrangement solely
for the reason that the Access Arrangement as revised would not address a
matter that sections 3.1 to 3.20 do not require an Access Arrangement to
address. In assessing proposed revisions to the Access Arrangement, the
Relevant Regulator:
(a) must
take into account the factors described in section 2.24; and
(b) must
take into account the provisions of the Access Arrangement.
