Where a prisoner is in
paid employment while absent from prison on an absence permit, the terms and
conditions, including the amount payable, in respect of the employment shall
be —
(a) the
terms and conditions including the amount payable under any award or agreement
in force under —
(i)
the Industrial Relations Act 1979 ; or
(ii)
the Industrial Relations Act 1988 of the
Commonwealth,
that applies to the
employment; or
(b) if
there is no such award or agreement — such terms and conditions,
including the amount payable, as are agreed upon by the employer and the chief
executive officer.
