This legislation has been repealed.
(1) The responsible
authority may, for the purpose of a town planning scheme, in the name and on
behalf of such authority —
(a)
purchase any land comprised in such scheme from any person who may be willing
to sell the same; or
(b) with
the consent of the Governor, take compulsorily, under and subject to Part 9 of
the Land Administration Act 1997 , (but subject to subsection (2)), any land
comprised in such scheme, and whether situate within or without the boundaries
of the district of such responsible authority.
(2) When any land is
taken compulsorily under the powers conferred by this section the provisions
of
(a)
sections 170 to 175 inclusive; and
(b)
section 184,
of the
Land Administration Act 1997 , shall not apply to or in respect of the land or
the taking or in any manner whatsoever, and that Act shall be read and
construed as if the provisions were deleted.
