Meaning of Whakatōhea
13 Meaning of Whakatōhea
1 In this Act,
"Whakatōhea" — a) means the collective group composed of individuals who
are descended from an ancestor of Whakatōhea; and
b) includes those
individuals; and
c) includes any whānau, hapū, or group, including the
following, to the extent that it is composed of those individuals: i) Ngāti
Rua:
ii) Ngāi Tamahaua:
iii) Ngāti Patumoana:
iv) Ngāti Ngahere:
v)
Ngāti Ira:
vi) Te Ūpokorehe.
2 In this section and section 14
,—
"ancestor of Whakatōhea" means an individual who— a) exercised
customary rights by virtue of being descended from— i) Muriwai or
Tūtāmure; or
ii) any other recognised ancestor of a group referred to in
subsection (1)(c)(i) to (vi); and
b) exercised the customary rights
predominantly in relation to the area of interest at any time after 6 February
1840
"customary rights" means rights exercised according to tikanga Māori,
including— a) rights to occupy land; and
b) rights in relation to the use
of land or other natural or physical resources
"descended" means that a person is descended from another person by— a)
birth; or
b) legal adoption; or
c) Māori customary adoption in accordance
with Whakatōhea tikanga.
