AIR NAVIGATION REGULATION 2016 - REG 26

Approval of tariffs

  (1)   If a licence holder submits a tariff to the Secretary under s ubs ection   25 (1) or (2) , the Secretary may:

  (a)   approve the tariff; or

  (b)   approve the tariff subject to conditions; or

  (c)   refuse to approve the tariff.

Note:   For review of a decision by the Secretary under this subsection, see section   42 .

  (2)   In making a decision under subsection   ( 1), the Secretary must take the following into account:

  (a)   the public interest;

  (b)   the relevant agreement for the scheduled international air service concerned ;

  (c)   the need for air transport services to operate on a satisfactory economic basis in an environment where there is due regard for the interests of consumers of those services.

  (3)   If the Secretary makes a decision under subsection   ( 1), the Secretary must give the licence holder notice, in writing, of :

  (a)   the decision; and

  (b)   the reasons for the decision.

  (4)   If the Secretary does not make a decision under subsection   ( 1) about a tariff within 7 days after the tariff is submitted to the Secretary under s ubs ection   25 (1) or (2) , the tariff is taken to have been approved under paragraph   ( 1)(a) of this section at the end of that period.
