RETAIL SHOP LEASES ACT 1994 - SECT 157
Existing dispute resolution proceedings
157 Existing dispute resolution proceedings
(1) This section applies if— (a) before the commencement, a party to a
retail tenancy dispute lodged a dispute notice under section 55; and
(b) on
the commencement, the retail tenancy dispute has not been resolved.
(2) Part
8 continues to apply in relation to the retail tenancy dispute as if the
Small Business Commissioner Act 2022 had not commenced.
(3) For subsection
(2), a reference in part 8 to a mediator includes a reference to a mediator
appointed, or taken to have been appointed under section 156, by the
commissioner.
(4) In this section—
"resolved" , in relation to a retail tenancy dispute, means— (a) a mediation
agreement has been signed by or for the parties to the dispute under
section 61; or
(b) an order has been made about the dispute by QCAT under
section 83; or
(c) the dispute notice for the dispute has been withdrawn
under section 91.
