The instrument making or evidencing the acting appointment may provide that the appointment has effect only in stated circumstances or subject to stated conditions or limitations.
Examples
1 The instrument relating to a standing (or dormant) acting appointment for a position provides that when the substantive occupant of the position (Y) is overseas X may act in the position, but may exercise stated powers of the position only with Y's approval.
2 X is appointed to act in Y's position if Y is out of the ACT and a declaration of acute fire danger is published under the ABC Act 2000 .
