Freedom of Information Amendment Act 1983 No. 81 of 1983 - SECT 38

38. Section 64 of the Principal Act is amended-

   (a)  by omitting sub-section (3) and substituting the following
        sub-section:

''(3) Notwithstanding sub-sections (1) and (2), but subject to sub-section
(4), the Tribunal is not empowered, in any proceedings other than proceedings
to determine a question referred to in sub-section 58 (4), (5) or (5A), to
require-

   (a)  the production of a document in respect of which there is in force a
        certificate under section 33, 33A, 34, 35 or 36; or

   (b)  the giving of information in respect of which a certificate is in
        force under sub-section 33 (4) or 33A (4).''; and

         (b)  by inserting in sub-section (4) ''any'' after ''the production,
in''.
