SOCIAL SECURITY LEGISLATION AMENDMENT ACT (No. 2) 1994 No. 109, 1994 - SECT 36

36. Section 46A of the Principal Act is amended:

   (a)  by omitting paragraph (1)(a) and substituting the following paragraph:

"(a) the person is requested under section 51A or 67A:

        (i)    to give the Secretary a written statement of the person's tax
               file number; or

        (ii)   to apply for a tax file number and give the Secretary a written
               statement of the person's tax file number once it has been
               issued; and";

   (b)  by omitting from paragraph (1)(b) "requirement" and substituting
        "request";

   (c)  by omitting paragraph (3)(a) and substituting the following paragraph:

"(a) the person's declaration states that the person has applied for a tax
file number; and";

   (d)  by inserting after paragraph (3)(b) the following paragraph:

"(ba) the Commissioner of Taxation has not told the Secretary that the person
has not applied for a tax file number; and".
