LAW ENFORCEMENT CONDUCT COMMISSION ACT 2016 - SECT 35
Making complaints to Commission
(1) Any person (including a public authority) may complain to the Commission
about conduct of a police officer, Crime Commission officer or
administrative employee that is (or could be) officer misconduct or
officer maladministration.
(2) Any person (including a public authority) may
complain to the Commission about conduct of the Crime Commission or the NSW
Police Force that is (or could be) agency maladministration.
(3) A
public official may complain to the Commission about the conduct of a
police officer, Crime Commission officer or administrative employee. Note :
Protections may be available under the following provisions to persons who
make a complaint referred to in this section-- (a) the
Public Interest Disclosures Act 2022 , Part 3--if the complaint is a
public interest disclosure,
(b) Part 6A--if the making of the complaint is
protected action within the meaning of the Part.
(4) This section does not
affect any other right of a person to complain about the conduct of a
police officer, Crime Commission officer or administrative employee or the
conduct of the Crime Commission or the NSW Police Force. Note : For example, a
complaint about the conduct of a police officer may also be made to the
Commissioner of Police under section 124 of the Police Act 1990 .
(5) In
this section--
"public official" has the same meaning as in the Public Interest Disclosures
Act 2022 .
