Internal arrangements for voluntary dispute resolution
144 Internal arrangements for voluntary dispute resolution
(1) The operator of a community may establish and from time to time vary
arrangements for resolving disputes arising in connection with the community,
whether the disputes arise between one or more home owners and the operator or
between home owners or otherwise.
(2) Attendance at, and participation in,
dispute resolution sessions under the arrangements is voluntary. Any party to
a dispute may withdraw from the resolution process at any time.
(3) If there
is a residents committee, action to establish or vary the arrangements can
only be made in consultation with the committee.
(4) The community rules may
(but need not) provide the mechanism for voluntary dispute resolution.
