Mediation procedure
151 Mediation procedure
(1) Unless the mediator decides otherwise, the mediation is to be held in
private and the mediator may exclude from the mediation any person apart from
the parties and their representatives.
(2) A party must, if required by the
mediator, disclose to the other party details of the party's case and of the
evidence available to the party in support of that case.
(3) Mediation may,
at the discretion of the mediator, be adjourned from time to time.
(4) The
mediator or a party may terminate a mediation at any time.
(5) A settlement
to which a party agrees in a mediation is binding on the party provided that
it is not inconsistent with this Act.
(6) The settlement must be put into
writing and signed by or for the parties.
Note--: Section 158 provides that
the Tribunal can make orders to give effect to any agreement or arrangement
arising out of mediation.
