RESIDENTIAL (LAND LEASE) COMMUNITIES ACT 2013 - SECT 90
Amendment of community rules
(1) The operator of a community may make written amendments to the
community rules.
(2) An amendment does not have effect unless-- (a) each
resident has been given written notice of the amendment, and
(b) if the
community has a residents committee--the operator has advised and consulted
with the committee about the amendment and has done so before giving notice to
residents under paragraph (a).
(3) The written notice must be given at least
30 days before the day on which the amendment is to have effect.
(4) On the
day that an amendment to the community rules takes effect, the community rules
are amended in accordance with the amendment. Note : See also section 95,
which enables the Tribunal to stay the time when an amendment to the
community rules takes effect.
(5) For the purposes of this section, an
amendment of community rules includes-- (a) a variation or deletion of a rule,
and
(b) the addition of a new rule, and
(c) the replacement of a rule with a
new rule, including the replacement of all the rules with a new set of rules.
