MEDICINES, POISONS AND THERAPEUTIC GOODS ACT 2012 - SECT 111

Manufacture, supply and use of paints for toys

    (1)     A person commits an offence if:

        (a)     the person manufactures a paint with the intention the paint be applied to toys; and

        (b)     the paint does not comply with the requirements prescribed by regulation.

Maximum penalty:     100 penalty units or imprisonment for 12 months.

    (2)     A person commits an offence if:

        (a)     the person supplies a paint; and

        (b)     knows the paint is to be applied to toys; and

        (c)     the paint does not comply with the requirements prescribed by regulation.

Maximum penalty:     100 penalty units or imprisonment for 12 months.

    (3)     A person commits an offence if:

        (a)     the person applies a paint to toys; and

        (b)     the paint does not comply with the requirements prescribed by regulation.

Maximum penalty:     200 penalty units or imprisonment for 2 years.
