Protecting officials from liability
234 Protecting officials from liability
(1) In this section—
"official" means— (a) the Minister; or
(b) the chief executive; or
(c) an
inspector; or
(d) a person acting under the direction of an inspector.
(2)
An official is not civilly liable for an act done, or omission made, honestly
and without negligence under this Act.
(3) If subsection (2) prevents a civil
liability attaching to an official (other than an external inspector or a
person acting under the direction of an external inspector), the liability
attaches instead to the State.
(4) If subsection (2) prevents a civil
liability attaching to an external inspector or a person acting under the
direction of an external inspector, the liability attaches instead to— (a) a
person designated under the intergovernmental agreement as the person to whom
liability attaches under this section for acts of the inspector; or
(b) if no
person is so designated—the State.
