INTERACTIVE GAMBLING (PLAYER PROTECTION) ACT 1998 - SECT 45
Show cause notice
(1) This section applies if the Minister believes— (a) a ground exists to
suspend or cancel an interactive gambling licence; and
(b) the act, omission
or other thing constituting the ground is of a serious and fundamental nature;
and
(c) either— (i) the integrity of the conduct of interactive games by
the licensed provider may be jeopardised in a material way; or
(ii) the
public interest may be affected in an adverse and material way.
(2) The
Minister must give the licensed provider a written notice (a
"show cause notice" ) that— (a) states the action (the
"proposed action" ) the Minister proposes taking under this division; and
(b)
states the grounds for the proposed action; and
(c) outlines the facts and
circumstances forming the basis for the grounds; and
(d) if the
proposed action is suspension of the interactive gambling licence—states the
proposed suspension period; and
(e) invites the licensed provider to show
within a stated period (the
"show cause period" ) why the proposed action should not be taken.
(3) The
show cause period must be a period ending at least 21 days after the
show cause notice is given to the licensed provider.
