LOCAL GOVERNMENT ACT 2009 - SECT 39

39 What this division is about

(1) This division is about beneficial enterprises that are conducted by a local government.

(2) This division does not apply to a business unit of a local government.

(3) A
"beneficial enterprise" is an enterprise that a local government considers is directed to benefiting, and can reasonably be expected to benefit, the whole or part of its local government area.

(4) A local government is
"conducting" a beneficial enterprise if the local government is engaging in, or helping, the beneficial enterprise.
