Cancellation procedure
195 Cancellation procedure
(1) If the valuer-general reasonably believes grounds exist to cancel a
suppression direction (the
"action" ), the valuer-general must give the protected person notice (the
"show cause notice" ) about the action.
(2) The show cause notice must
state— (a) the action proposed; and
(b) the grounds for proposing to take
the action; and
(c) the facts and circumstances that form the basis for the
valuer-general’s belief; and
(d) that the protected person may show cause,
within a stated period, why the action proposed should not be taken.
(3) The
stated period must be at least 42 days after the protected person receives the
notice.
(4) If, after considering all representations made within the stated
period, the valuer-general still believes that grounds to take the action
exist, the valuer-general may cancel the suppression direction.
