Obstructing persons exercising powers
146 Obstructing persons exercising powers
(1) A person must not obstruct any of the following in the exercise of a power
under this chapter, unless the person has a reasonable excuse— (a) the chief
executive;
(b) a doctor;
(c) an authorised person;
(d) a person in charge
of a public sector health service;
(e) a person authorised by a person in
charge of a public sector health service.
Penalty— Maximum
penalty—100 penalty units.
(2) If a person has obstructed a person
mentioned in subsection (1) (a) to (e) (the
"enforcing person" ) and the enforcing person decides to proceed with the
exercise of the power, the enforcing person must warn the person that— (a)
it is an offence to obstruct the enforcing person, unless the person has a
reasonable excuse; and
(b) the enforcing person considers the person’s
conduct is an obstruction.
