Protection of expressions associated with statutory insurance scheme
71E Protection of expressions associated with statutory insurance scheme
(1) A person must not use a declared expression in connection with selling the
right to participate in any warranty or insurance scheme unless— (a) the
scheme is that to which this Act relates; and
(b) the person does so on
behalf of the commission.
Penalty— Maximum penalty—100 penalty
units.
(2) A person must not— (a) use any variation of a
declared expression; or
(b) use any word (either alone or in conjunction with
any other word) similar in sight or sound to a declared expression;
in
connection with selling the right to participate in any insurance or warranty
scheme, being a use likely to afford reasonable grounds for believing the
scheme is or is associated with the scheme to which this Act relates,
unless— (c) the scheme in question is one to which this Act relates; and
(d) the person does so on behalf of the commission.
Penalty— Maximum
penalty—100 penalty units.
(3) In this section—
"declared expression" means the name prescribed under section 67X or another
name prescribed by regulation.
