After section 66 —
insert—
66A Employee notice—intention to take cultural parent leave(1) This section applies if an employee wants to take cultural parent leave.(2) The employee must give the employer—(a) for long cultural parent leave—written notice of intention to take the leave at least 10 weeks before the expected date when a cultural recognition order will be made transferring a child’s parentage to the employee (the
"expected parental transfer date" ); and(b) at least 4 weeks written notice of the dates on which the employee wants to start and end the leave.(3) The employee must, before starting the leave, give the employer a statutory declaration by the employee stating—(a) the employee is an intended cultural parent; and(b) the expected parental transfer date; and(c) for long cultural parent leave—(i) the period of leave sought by the employee; and(ii) the period of any cultural parent leave sought by the employee’s spouse; and(iii) that the employee is seeking the leave because the employee is to be responsible for the care of the child.
