40—Forfeiture of surveillance devices
(1) If a person is
convicted of an offence against this Act, the court before which that person
was so convicted may in addition to imposing any other penalty order that a
surveillance device or record of any information or material in connection
with which the offence was committed is forfeited to the Crown.
(2) A
surveillance device or record of information or material forfeited to the
Crown pursuant to an order under subsection (1) may be retained,
destroyed or otherwise disposed of in a manner directed by the Minister.
