(1) The Board may, if
satisfied that a working with children check has not been conducted in
relation to a registered social worker within the preceding 5 years suspend
(without any requirement for a hearing or other process) the registration of
the social worker.
(2) A suspension under
this section has effect—
(a)
until the fulfilment of specified conditions or until further order of the
Board; or
(b) if
the social worker's registration is cancelled under
section 46(5)—until that cancellation has effect,
whichever occurs first.
(3) To avoid doubt, a
suspension of a social worker's registration under this section has effect
whether or not an appeal has, or is to be, instituted against the decision to
suspend the registration of the social worker.
