13—Prescribed drugs and non-complying sample
For the purposes of Part 3A Division 2 of the Act—
(a) a
"prescribed drug" is—
(i)
a controlled drug (other than a drug of dependence)
within the meaning of the Controlled Substances Act 1984 ; or
(ii)
a drug referred to in Schedule 8 of the current
Poisons Standard within the meaning of the Therapeutic Goods Act 1989 of
the Commonwealth; and
(b) a
"non-complying sample" is a sample of blood or urine containing any trace of a
prescribed drug.
